Terms & Conditions

General

· Dancers and parents/guardians (of under-age dancers) undertake to comply with the CF Els Dance Studios Terms and Conditions at all times;

· Dancers and parents/guardians (of under-age dancers) acknowledge that participation in events sanctioned and organized by Solo Dança Latina and Mr. Mark Dooley is also subject to the Terms and Conditions of Solo Dança Latina;

· CF Els Dance Studios’ Terms and Conditions are subject to change without notice.

Studio Dance Year

· The Studio Dance Year runs from March to February for every year;

· Registration Fees, Class Fees, Cloth Numbers, Competitions, Rankings, Medal Achievements and Qualifications are determined and are valid for the Dance Year.

Annual Registration

· Each Dancer is required to Register annually to obtain a Cloth Number;

· Cloth Numbers are issued by Solo Dança Latina;

· Dancers require a Cloth Number to enter any competition sanctioned by Solo Dança Latina;

· Each Dancer is required to pay an Annual Registration Fee (determined by Solo Dança Latina), regardless of date of joining the Studio or sign-up date

· Registration Fees are not negotiable;

· Registration Fees are non-refundable.

Fee Structures

· Class Fees are determined annually for the Dance Year for the full year (12 months);

· Class Fees are paid monthly in advance, before the 7th of the month;

· Class Fees remain payable in cases of absence. No reductions in Class Fees for absence, sickness or holidays;

· Class Fees do not include exam or competition registration/entry fees;

· Class Fees are non-refundable;

· Class Fees may be subject to change with appropriate notice to Dancers.

Payment of Fees

· I agree to pay all Fees due, promptly;

· I agree to pay Class Fees in advance, before the 3rd of each month;

· CF Els Dance Studios’s preferred payment method is via EFT directly into the nominated banking account;

· Cash Deposits into the nominated banking account will incur an extra cash deposit fee;

· Cheques are not accepted unless by arrangement and agreement with CF Els Dance Studios;

· Dancers or Parents/Guardians agree to pay interest at a rate of two percent (2%) per month or portion thereof on outstanding fees from the due date until the date of payment;

· All payments shall be made in South African currency.

Class Attendance

· Dancers should attend classes regularly;

· Dancers should arrive promptly and be correctly dressed for their lessons;

· CF Els Dance Studios will hold within its sole discretion the final say as to the suitability of a Dancer to be entered for examinations, competitions and/or shows/concerts and may, at its sole and exclusive discretion, withdraw or hold back from any such specified events, any Dancer which in the opinion of CF Els Dance Studios, appears to be inadequately prepared due to poor attendance and/or performance;

· Parents/Guardians are responsible for under-aged children whilst at classes, workshops, rehearsals or performances;

· CF Els Dance Studios does not accept responsibility for students outside of classes, workshops, rehearsals or performances.

Termination of Agreement

· Dancers or Parents/Guardians are required to provide one calendar month’s Written Notice if they wish to terminate their agreement;

· Termination Forms are available on CF Els Dance Studio’s website;

· Dancers or Parents/Guardians agree to ensure that, upon termination, all fees due are fully paid up;

· Class Fees are non-refundable.

Liability Waiver and Acknowledgment of Risk

· I understand and agree that in participating in any dance class, workshop, rehearsal or performance, that there is a possibility of physical injury or death.

· I voluntarily agree, therefore, to assume all risks and responsibility for any such injury or accident, which may occur to me or my child during any of CF Els Dance Studios classes, workshops, rehearsals or performances;

· Furthermore, I also exempt and indemnify CF Els Dance Studios and Solo Dança Latina , their owners, volunteers, assistants, employees, guest artists and/or students from any and all liability claims, demands or causes of action whatsoever from any damage, loss, injury or death to me, my children or property which may arise out of or in connection with participation in any classes or activities CF Els Dance Studios and Solo Dança Latina;

· Additionally, I hereby agree to waive my rights and that of my heirs and assigns to hold CF Els Dance Studios and Solo Dança Latina, their owners, volunteers, assistants, employees, guest artists and/or students liable for such damage, loss, injury or death;

· I understand that I should be aware of my, or my child’s physical limitations and agree not to exceed them;

· I also understand that it is my duty to ensure that CF Els Dance Studios is aware of any medical condition or issue that I, or my child may suffer from;

· CF Els Dance Studios and Solo Dança Latina will strive to ensure that all reasonable safety precautions are taken prior to and during classes, workshops, rehearsals or performances;

· I understand when learning to dance, it may be necessary for the instructor to correct my or my child’s posture or body line, which may involve physical contact to be made by the instructor;

· In the case of under-aged dancers, I certify that I am the parent or legal guardian of the child and duly authorised to waive these rights.

Intellectual Property

· I understand and agree that all the dance routines taught by CF Els Dance Studios are the intellectual property of Solo Dança Latina;

· I understand and agree that only current CF Els Dance Studio registered teachers, trained by Solo Dança Latina, are allowed to teach the routines;

· I understand and agree that external public performances of these works at talent competitions, school reviews, etc, will not be allowed without the written permission from the CF Els Dance Studio;

· I understand and agree that no video recordings are permitted during classes, workshops or rehearsals, unless authorised by CF Els Dance Studios;

· Furthermore, permission is granted to CF Els Dance Studio to use photographs and video of students for publicity purposes;

Acceptance

· I understand that by registering as a dancer with CF Els Dance Studios, I have read and understood the content of this agreement;

· No variation or amendment of these Terms and Conditions and no extension of time, waiver or relaxation or suspension of any of the provisions or terms of these Terms and Conditions shall be binding or have any force and effect unless reduced to writing.
